Be eligible for divorce in Australia. You or your spouse must be an Australian citizen, permanent resident, or regard Australia as your permanent home.You must have been separated for at least 12 months with no reasonable likelihood of reconciliation. If you have lived under the same roof during separation, you’ll need extra evidence to prove you were separated.

Get a lawyer to help you prepare the application. You can apply solely (by yourself) or jointly (together with your spouse). We will need a copy of your marriage certificate (with an English translation if not in English).

Serve the Application. If you apply alone, you must serve your spouse with the court documents at least 28 days before the hearing (42 days if they are overseas). You cannot serve the documents yourself — a third party must do it.

Wait for the outcome. If granted, your divorce becomes final one month and one day after the court makes the divorce order.
