
Once a final Family Violence Intervention Order (FVIO) or Personal Safety Intervention Order (PSIO) is made, the respondent is classified as a ‘prohibited person’ under the Firearms Act 1996 (Vic).
The court can suspend or cancel a respondent’s firearms licence when making the final order.
A respondent does not become a ‘prohibited person’ if an interim order is made against them.
If a final order does not include licence conditions, the respondent is still a prohibited person for the duration of the final order and for a further five years after the final order expires but may apply under the Firearms Act 1996 to become a non-prohibited person to restore their licence.
If the final order cancels the licence, reinstatement options are very limited, and there is no right of appeal or review for this cancellation.
