Probate

1
Obtain the Certified Death Certificate
The process cannot begin until the Cause of Death Certificate is provided.
2
Contact all asset holders
Your lawyer will ask you for a list of the assets owned by the deceased and the value of those assets as at "date of death". This is required for the application. If you cannot retrive this information, we can help you.
Do I need Probate?
You will need to obtain Probate if banks, nursing homes, or any other organizations holding the deceased’s assets require a copy of the Grant of Probate before releasing those assets to you. If these organizations do not request Probate and are willing to release the assets without it, then Probate is likely not necessary. However, if you are the executor and there is a risk of family disputes or challenges to the Will, it is advisable to obtain Probate to protect your legal authority in administering the estate.
Fixed fee arrangements for applications for Probate or Letters of Administration from $2,750. Dependent on the complexity of the matter. Contact us to find out more.
